Getting support from an IP expert
In the event of an intellectual property dispute: legal information by phone, a quick diagnosis, then individual support, even before knowing whether action is needed.
Support
Who steps in, when, and to what end.
1 business day
First-response time from legal support on your case.
Legal support in two stages
With your subscription, Covéa Protection Juridique's in-house legal experts answer your questions by phone, Monday to Saturday. For individual support on your case, a preliminary diagnosis is carried out first. Once this diagnosis is validated, an IP expert follows your case and relies on the history of your deposits.
Assessing the infringement before any action
This diagnosis establishes the legal nature of the infringement (which right is at stake, what wrongdoing is alleged): it assesses whether the infringement is real, how strong the evidence is and the extent of the harm. Some cases are settled at this stage. A clarification may be enough when the reuse is not wrongful.
Negotiating before litigating
A formal notice, taking down a publication, a retroactive license, an amicable settlement: the fastest route is rarely the courtroom. If proceedings become necessary, the insurance covers lawyer's fees within the limits of your plan.
In a dispute
The process, step by step
An intellectual property dispute is rarely settled in court. The process is designed to look for the fastest solution first.
1. A call to take stock
With your subscription, Covéa Protection Juridique's legal experts answer your questions by phone, Monday to Saturday. You quickly know whether the situation is a dispute and how to report it.
2. Conciliation first
Once the dispute is reported, Covéa's legal experts first seek an amicable solution: removal, regularization, a negotiated agreement. Many cases are settled at this stage.
3. Specialized lawyers if needed
If proceedings become necessary, Ipocamp refers you to lawyers specialized in intellectual property and supports the case. Your costs are covered up to your plan's cap: €5,000 or €10,000 per dispute.
Getting ready
What makes your case strong
On the day of a dispute, three elements weigh more than any others. They are built up beforehand, not after the fact.
Verifiable dates
Your Ipocamp certificates establish what existed, and when. They are admissible in civil matters under the principle of freedom of evidence (Article 1358 of the French Civil Code).
The creative process
Successive versions, sketches and intermediate stages show how the work was conceived. This is often what convinces a judge of originality (the mark of the author's personality) and authorship.
Ownership of the rights
Employment contracts, written assignments with your contractors, agreements between co-founders: without them, even dated proof can be challenged on who owns the creation.
